Justice B. Vijaysen Reddy of Telangana High Court on Tuesday (March 11, 2025) issued notices to Peddapalli Junior Civil Judge-cum-Judicial Magistrate of First Class N. Manjula and two others over arrest and judicial remand of a person in violation of principles laid down by Supreme Court.
Notices were also issued to Peddapalli circle inspector Kondapaka Praveen Kumar and sub-inspector J. Lakshman Rao in the writ petition field by a person K. Krishna. The petitioner alleged that he was arrested in a criminal case registered on charge of wrongful restraint and assaulting a public servant.
The police invoked sections 126 (2) and 132 read with 3 (5) of BNS. The maximum punishment under the two sections was not more than two years and hence the police should not have sought remand of the accused, the petitioner’s counsel said. The apex court laid down guidelines to be followed in such matters. The matter was posted to March 19 for next hearing.
