The Supreme Court of India recently made significant remarks on dispelling sexual misconceptions to create a more sexually aware society, which would result in decreased sexual crimes in the country. The court made these observations during the hearing of the case of “Just Rights for Children Alliance v. S. Harish & Ors.”

The bench led by Chief Justice D.Y. Chandrachud and Justice J.B. Pardiwala pointed out that the main reason for a significant knowledge gap in society when it came to sexual education is due to the social stigma surrounding such issues. This often leads to youngsters turning to the internet for information, which can be very misleading and false at times.

The court said that many parents, as well as teachers, are hesitant to talk about sexual health and good sexual practices because they feel that these topics would morally corrupt the children, leading them to start indulging in sexual acts from an early age. The court highlighted that research has shown the opposite of this to be true.

The court also debunked the notions that sex education is a “Western concept”, and is incompatible with Indian values, further saying that proper education leads to more awareness among youngsters from an early age, which decreases the instances of sexual crimes and distribution of child pornography.

The court reversed the Madras High Court ruling, which had stated downloading and viewing of child pornography not to be an offence under POCSO. This has now made both downloading and watching child pornography a criminal offence, eligible for trial under the POCSO Act.
