The Supreme Court of India has rejected a Public Interest Litigation (PIL) that called for an independent body to oversee content on OTT platforms like Netflix.
The court, led by Chief Justice DY Chandrachud, stated that this issue should be managed by the government, which must consult various stakeholders before making any decisions.

The judges noted that regulating content involves complex policy decisions better suited for the government rather than the judiciary.
This ruling means that the government is responsible for finding a way to regulate OTT content while still allowing for creative freedom and expression.

The lawyer who filed the PIL, Shashank Shekhar Jha, intended to raise concerns about how OTT platforms, like the series about the Kandahar hijacking, may misrepresent events.
He argued that while movies in theaters are reviewed by a certification board, OTT platforms operate without a similar oversight body. This lack of regulation could lead to misuse of freedom of expression, which is protected under the Indian Constitution.

With over 40 OTT platforms in India, the petition highlighted the need for guidelines to ensure responsible content creation.
