Rape Being Used as Weapon to Harass Men

A classic case of rape-related extortion was filed in the Delhi High Court. The twist, however, is that it was actually denied on the grounds of it being a misuse of Article 376 of the Bharatiya Nyaya Samhita (Indian Penal Code) 1860.

The court mentioned how a person was actually brought before court for a crime he didn’t even commit, as the charges were false. Justice Chandra Dhari Singh mentioned in his statement—

“It is true that the provision under which the FIR has been lodged is one of the most heinous crimes against women; however, it is also an established fact that some people use it as a weapon to unnecessarily harass the male counterpart.”

The complaint was filed in September 2021. In which the man was charged with sexual harassment. The man pleaded that the one who complained and himself were in a relationship and had thus maintained a physical relationship under the consent of both parties.

The man mentioned in his statement that there was in fact no pretext of marriage whatsoever, and thus he has been accused falsely of making physical relations with the women under such false promises of marriage.

However, after the plea was made, he was still ready to enter marriage, but the woman denied any interest. In the end, the WhatsApp chats between the two were used as proof to prove the man’s innocence.
