Attention all H1B workers! If your H1B change of status was approved for October 1, it’s crucial to understand that you must start working under your H1B status, even if you have a valid work authorization from your previous visa.

For example, if you are working in the U.S. in a period of STEM OPT and your EAD expires on December 31, 2024, your H1B status starts on October 1, 2024. Even if your OPT card expires at a later date, you are required to follow the rules of the new H1B status and may no longer work using your STEM OPT work authorization after October 1.

The most important thing that will help you keep your legal status in the United States is compliance, so remember to follow the rules associated with your H1B approval. This transition happens automatically, but working under the wrong authorization may cause problems with your immigration status later on.
