Big Win For Indian H-1B Visa Families!

    H-1B Visa

Great news for Indian tech workers in the US!

An appeals court has confirmed a rule allowing spouses of H-1B visa holders to work in the US. This decision was made by a three-judge panel of the US Court of Appeals for the District of Columbia Circuit.

They dismissed a challenge from Save Jobs USA, a group representing US-born tech workers, ensuring that the rule established during the Obama administration stays in place.

The rule, introduced by the Department of Homeland Security (DHS) in 2015 under President Obama, allows certain spouses of H-1B visa holders to work in the US.

Save Jobs USA argued against this rule, claiming it threatened US jobs. However, the court upheld the rule, stating that DHS has the authority to implement it, referencing past decisions that supported similar rules.

Leading tech companies like Google, Amazon, and Microsoft supported the rule, arguing that it benefits the US economy by retaining highly skilled employees.

They believe that allowing H-4 spouses to work will encourage H-1B workers to seek permanent residency, helping maintain the competitiveness and innovation of the US tech industry.

This decision is especially significant for Indian skilled workers, as many top H-1B visa employers are Indian outsourcing firms.
