Donald Trump’s executive order to deny birthright citizenship to individuals on temporary work visas, tourist visas, and student visas has created shockwaves within the Indian community in the U.S., particularly among those currently on visas like H1-Bs, H4s.
Families expecting babies soon are especially impacted and find themselves in a state of utter confusion. According to the executive order, February 29 is the deadline. After this date, babies born in the U.S. will no longer receive U.S. citizenship or a U.S. passport.

This has caused significant concern for the Indian community, especially families anticipating childbirth in the coming months. There is no clear information or guidelines regarding the status of newborns after February 19, leaving parents uncertain about the legal status of their child or how to report their circumstances and to whom. The situation is highly chaotic.
Ironically, a large portion of the Indian community supported Trump during his election campaign, including both those with voting rights and those without. Now, many regret their decision, as this executive order has directly impacted them so soon after Trump took office.

Trump supporters argue that the order addresses the misuse of U.S. citizenship by illegal immigrants and others who travel to the country specifically to give birth and secure U.S. citizenship for their children. However, several lawsuits have been filed to challenge the executive order, and it may take time before the courts reach a decision.
In the meantime, Indian families expecting babies in the coming months remain deeply worried about the uncertainty surrounding their children’s future legal status.
