New Delhi: The Supreme Court (SC) in Writ Petition (Civil) No. 289 of 2016 was pleased to dismiss a Public Interest Litigation filed by S Srinivasan seeking segregated data of Phase-III double blind clinical trial results of Rotavirus Vaccine Manufactured by Bharat Biotech.
The Apex Court considered the arguments on merits, and dismissed the writ petition on the ground that this is a roving inquiry by the petitioner, and the petitioner has failed to disclose the entire facts before the Court.
Furthermore, it was also stated that the SC has already decided this issue in Jacob Puliyel v Union of India, Writ Petition (Civil) No. 607 of 2021 and the Court cannot sit over the analysis of experts appointed by the Government of India in high level technical teams.
The current writ petition with similar reliefs was earlier filed by Dr Jacob Puliyel in the Delhi High Court and the same was dismissed on the ground that the writ petition is misconceived and motivated with private interest.
Additionally, it was stated that no case is made out to show that disclosure of the segregated data is essential in public interest.
Thereafter, the Supreme Court dismissed the appeal filed by Dr Jacob Puliyel on the ground that Dr Puliyel, who was a member of the National Technical Advisory Group On Immunisation, cannot maintain a petition in public interest.
