The AAP alleged on Wednesday that when there was a possibility of Delhi Chief Minister Arvind Kejriwal getting bail from the Supreme Court in a money laundering case, the BJP panicked and got him arrested in a “fake case” by the CBI.

Earlier in the day, a Delhi court allowed the CBI to formally arrest Kejriwal in the Delhi excise policy case.

The CBI arrested Kejriwal after Special Judge Amitabh Rawat passed the order. The agency has sought five-day custody of the chief minister in the case.

In a post in Hindi on X, the AAP said, “The dictator crossed all limits of cruelty!! Today when there was every possibility of Chief Minister @ArvindKejriwal getting bail, the BJP went into panic mode and got Kejriwal arrested by the CBI in a fake case.”

“The CBI took Kejriwal ji to Rouse Avenue Court where his blood sugar level dropped very low. Dictator, no matter how much oppression you inflict, Kejriwal will neither bow down nor break,” it said.

He says that Kejriwal’s arrest is the “biggest abuse of process of law.” He adds that the arrest & remand’s prayer is “unscrupulous”.

Arvind Kejriwal’s Lawyer Vikarm Chaudhari says that Kejriwal has been arrested by violating section 41 of CrPC.

Kejriwal’s lawyer Vikarm Chaudhari said that the remand application is “totally vague”. It’s a classic case of abuse of power. The principles of Arnesh Kumar and Satinder Kumar Antil are required to be applied in “letter and spirit” in this case.

He further pointed out that though Kejriwal’s name was cropping in almost every chargesheet but the CBI chose to maintain “eerie silence”. He adds that the timing of arrest by the CBI points towards the illegality of the arrest

The Supreme Court on Wednesday allowed Delhi chief minister Arvind Kejriwal to withdraw his petition against the interim stay on his bail granted by the Delhi high court last week and file a fresh petition to also include the challenge to the HC’s final order

of June 25 order reversing the bail in the Delhi excise scam case probed by the Enforcement Directorate (ED).

A vacation bench of justices Manoj Misra and SVN Bhatti passed the order after a request for withdrawal was made by senior advocate Abhishek Manu Singhvi appearing for the national convenor of the Aam Aadmi Party (AAP).

Singhvi pointed out that since the passing of the June 21 order by the HC when an interim stay was granted on the bail order passed by the trial court on June 20, subsequent developments have taken place as the high court has pronounced its final order on June

25 and Kejriwal has been arrested by the Central Bureau of Investigation (CBI) in connection with the Delhi excise policy case.

CBI SSP Singh responds saying that it didn’t want to overreach the Supreme Court as the top court was considering grant of interim bail. He says that the probe agency got the sanction to prosecute under section 17A of the Prevention of Corruption Act came in April but it showed restraint as the Supreme Court was considering interim bail.

“We did not want to over reach the majesty of the SC. He says that sanction under section 17A of the Prevention of Corruption Act came in April… We showed our restraint. Every time we have tried to show our restraint. Now it is absolutely mandatory cause now we want to conclude (the investigation) by July 3. There is an emergency for it. We will try to file the chargesheet thereafter,” Singh says to court

CBI seeks 5 days remand of Delhi CM Arvind Kejriwal for custodial interrogation. It says that it needs to confront the CM with documents

Delhi Chief Minister Arvind Kejriwal withdrew from the Supreme Court on Wednesday his plea challenging the Delhi High Court order granting an interim stay on the operation of the trial court’s bail order in a money laundering case linked to the alleged excise scam.

A vacation bench of Justices Manoj Misra and SVN Bhatti, which allowed Kejriwal to withdraw his plea, was told by the AAP leader’s counsel senior advocate Abhishek Singhvi that since the high court has passed a detailed order on June 25, he would like to file a substantial appeal.

Singhvi informed the bench that new developments were taking place every day and Kejriwal has now been arrested by the CBI.

“We would like to file a substantial appeal to bring on record all relevant details and challenge the June 25 order of the high court in which bail order was finally stayed,” he said.

CBI says that it needs Kejriwal’s custodial interrogation since he is failing to even recognise that Vijay Nair was working under him. Singh says that Kejriwal had said that Nair was working with Saurabh Bhardwaj and Atishi Marlena, adding that the CM is “pushing the entire onus on Manish Sisodia & saying that he has no idea about the excise policy.”

Singh adds that when the probe agency asked Kejriwal if he had gone to Goa, he said, “I don’t remember.”

Delhi CM Arvind Kejriwal was brought out of the courtroom for tea and biscuits after his sugar level dropped. He was taken to the Ahlmad room.

The CBI counsel told the court that the Group of Ministers were presented with a report that held favourable views of the policy. The report was then accepted without any minutes of the meeting and no discussion on the wholesale model that was being proposed.

The commission for liquor sellers had also been changed from 5 to 12 per cent

The Court has asked the CBI about the procedure by which the report was made by the AAP government for the excise policy. After outlining the procedure the CBI claimed that public views were used to formulate the policy.

The court then questioned the CBI’s counsel about whether that can be constituted as illegal, as public views can be used when creating policy

CBI SSP Singh said in the court that the 36 page GoM report was prepared by the South Group. South group came on a private flight. He added that the officers who were not happy to sign the file notings were changed.

Singh says that the probe agency has evidence to show that it was the Aam Aadmi Party (AAP) which was trying to get the comments from particular people. We have evidence to show that the comments were fabricated. There were chats which were seized.

Taking the court through the facts of the case & Kejriwal’s alleged involvement, CBI SSP Singh said that CM’s close confidant Vijay Nair was given the responsibility to coordinate.

He adds that GoM report was prepared by the South Group and the same had gone to LGs office. He says that meetings had started even during the lock down and a team from the South had come to Delhi on a private flight.

SPP DP Singh for CBI said in the court that the probe agency refrained from investigating the CM while he was on interim bail.

Proceedings commence in the courtroom again after CBI’s arrest.

The CBI has formally arrested Delhi Chief Minister Arvind Kejriwal on Wednesday. The development came after the Rouse Avenue Court allowed the CBI to examine Kejriwal in the courtroom and asked it to place on record the material that they have for his arrest

Kejriwal was brought to Rouse Avenue Court by CBI on Wednesday morning for a hearing in the excise policy case where Kejriwal’s wife Sunita Kejriwal also accompanied him.

Meanwhile, the Supreme Court will also hear Arvind Kejriwal’s petition against the Delhi High Court order putting an interim stay on his bail in the money laundering case linked to liquor excise policy.

The probe agency had on Tuesday examined the AAP supremo in Tihar Jail and recorded his statement related to the Excise Policy case.

SPP DP Singh urges the court to permit the CBI to take Kejriwal to Ahlmad room and finalise the arrest. “They do not have the right to advance notice. Today, whatever I will be moving after his arrest, they will have all the applications,” Singh says.

Vikram Chaudhari, advocate for Arvind Kejriwal said that denial of opportunity to his client to not file the reply to the remand application and not put him to notice violates fundamental right under article 21. He urges the court to grant the CM formal chance to file the reply.

Arvind Kejriwal’s advocate Vikram Chaudhari said, “Heavens will not fall if we will file a reply. No section 41A notice was given by the CBI.”

Kejriwal’s advocate Vikram Chaudhari said that Kejriwal was not given any opportunity and urged the court to grant time to file their response to CBI’s remand application. Chaudhari said that there is no statutory provision seeking permission to arrest.

The official said that there is no mandate on the agency to inform the other side under law.

“I am seeking permission only because he is in my lords custody. To investigate is my prerogative & I don’t need to seek their permission & it is not necessary for me to supply them applications regarding interrogation,” CBI SPP DP Singh says.

CBI represented through SPP DP Singh says that the agency could’ve done the exercise before the elections but we did not. “We could’ve done the exercise before the elections but we did not. It is only after he went back, we sought permission. It is very unfortunate when a political dispensation does something of this sort where they are dealing with suitors before finalising the policy,” Singh says.

Senior advocate Vikram Chaudhari also for Kejriwal says his client was in custody in one case.

In a blow to Delhi Chief Minister Arvind Kejriwal, the Delhi High Court on Tuesday stayed the trial court order granting him bail in the money laundering case arising from the alleged excise scam, holding that the lower court did not “appropriately appreciate” the material placed before it by the Enforcement Directorate.

A vacation bench of Justice Sudhir Kumar Jain said the ED’s contentions assailing the bail order required serious consideration.

“The Vacation (trial) Judge while passing the Impugned Order did not appropriately appreciate the material/documents submitted on record and pleas taken by ED and the averments/grounds as raised in the petition under section 439(2) of the Code require serious consideration,” it said.

“Accordingly, the present application is allowed and the operation of the Impugned Order is stayed,” the court said.

AAP leader Sanjay Singh alleged on Tuesday that the BJP has hatched a conspiracy with CBI officers to frame Delhi Chief Minister Arvind Kejriwal in a “fake case”.

There was no immediate reaction to the allegation from the Central Bureau of Investigation (CBI) or the Bharatiya Janata Party (BJP).

In a video message on X, Singh wondered how would one get justice when such things are happening.

“We have learnt from reliable sources that the BJP-led Centre has hatched a conspiracy with CBI officers at a time when there is a huge possibility of Kejriwal getting bail from the Supreme Court. They have planned to frame him in a fake case by the CBI and get him arrested.

Shortly after the CBI examined Kejriwal in Tihar jail, the AAP alleged that the BJP-led union government and the CBI are “conspiring” to register a fake case against the Delhi CM ahead of a court hearing. “At a time when there is a cent per cent possibility that Arvind Kejriwal will get bail from the Supreme Court, sources have informed me that the Centre is conspiring to register a fake CBI case against the Delhi CM and get him arrested by the CBI…The entire nation can see this and is standing in solidarity with Arvind Kejriwal,” AAP Rajya Sabha MP Sanjay Singh said.

According to the Delhi high court, the previous trial court’s observation that the voluminous material presented by the ED could not be considered, was “totally unjustified.” “Observation by the trial court that voluminous material cannot be considered is totally unjustified, and it shows that the trial court has not applied its mind to the material,” the court said.

After the Central Bureau of Investigation examined Delhi CM Arvind Kejriwal in Tihar Jail and recorded his statement related to the Excise Policy case, Delhi Bharatiya Janata Party president Virendraa Sachdeva suggested Aam Aadmi Party leaders Saurabh Bharadwaj, Atishi, and Sanjay Singh to question Congress party and said that the case on which the CBI is working, was lodged by the Congress.

The Aam Aadmi Party on Tuesday alleged that the BJP-led Union government and the Central Bureau of Investigation are conspiring to register a fake case against Delhi chief minister Arvind Kejriwal ahead of a court hearing. The Supreme Court will hear Kejriwal’s plea on June 26 against the Delhi high court order putting an interim stay on his bail in the money laundering case.

Delhi Minister Saurabh Bharadwaj on Tuesday said that it is very unusual that without reading the order of the trial court, Delhi High Court stayed the court order granting bail to Delhi Chief Minister Arvind Kejriwal.

Speaking to ANI, the senior Aam Admi Party (AAP) leader said, “It is very unusual that without reading the order of the trial court, Delhi High Court stayed the court order granting bail to Kejriwal…We will make a legal strategy regarding it…”

The Central Bureau of Investigation on Tuesday examined Delhi Chief Minister Arvind Kejriwal in Tihar Jail and recorded his statement related to the Excise Policy case.

Arvind Kejriwal was arrested by the Enforcement Directorate in the Excise Policy money laundering case on March 21, 2024, and is presently in Judicial Custody in the case.

The probe agency on Tuesday also got permission for Arvind Kejriwal’s production before the concerned trial court on Wednesday. He will be produced before the concerned court on Wednesday.

According to the CBI sources, he is likely to be officially arrested in the case before the court today.
